End User License Agreement (EULA)

1. Grant of License

PumpyDumpy ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to install and use PumpyDumpy2Visual ("Software") on a single computer for personal or commercial use, subject to the terms and conditions of this Agreement.

The Software is available in two editions:

• Free Edition. The Free Edition provides access to all features of the Software. However, a watermark overlay ("PumpyDumpy2Visual FREE VERSION") is displayed on the live preview and on all exported Output Files. The watermark may not be removed, hidden, or circumvented by any means.
• Pro Edition. The Pro Edition removes the watermark. It requires a valid license key purchased from the Licensor or an authorized distributor. The license key is validated periodically (approximately every seven days) via an internet connection. If validation fails within the grace period, the Software reverts to the Free Edition.

This license does not constitute a sale of the Software. The Licensor retains all right, title, and interest in and to the Software.

2. Prohibition of Copying

You may NOT:

• Copy, reproduce, or duplicate the Software except for a single backup copy for archival purposes.
• Distribute, share, lend, rent, lease, sublicense, or otherwise make the Software available to any third party.
• Upload the Software to any file-sharing service, torrent, public server, or any other distribution channel.
• Remove, alter, or obscure any copyright notices, trademarks, or other proprietary markings.

3. Prohibition of Reverse Engineering

You may NOT:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software.
• Modify, adapt, translate, or create derivative works based on the Software.
• Attempt to bypass, disable, or circumvent any technological protection measures, license keys, watermarks, or security features.
• Analyze the Software's code, algorithms, data structures, or protocols through any means.
• Remove, hide, alter, or interfere with the watermark displayed in the Free Edition.

4. Output Files and User Content

• Ownership of Output. All files generated by the Software ("Output Files") are the sole property of the User. The Licensor claims no ownership over Output Files.
• User's Responsibility. The User is solely responsible for the Output Files and their use, including compliance with applicable laws and third-party copyrights.
• No Liability for Output. The Licensor bears no responsibility for the content, quality, or legality of Output Files.

5. Limitation of Liability

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THE LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

6. Intellectual Property

The Software, including its code, graphics, user interface, documentation, and all associated materials, is protected by copyright laws and international treaties. All rights not expressly granted are reserved.

7. Third-Party Components

The Software includes third-party components governed by their own licenses:

• FFmpeg and FFprobe — Licensed under GNU GPL v3.0. Source code at ffmpeg.org.
• Bundled Fonts — Licensed under SIL Open Font License 1.1 or Apache License 2.0.
• Sample Audio — 19 tracks by Kevin MacLeod (incompetech.com), licensed under Creative Commons: By Attribution 4.0. Credit required if used in published output.
• Electron and Chromium — Licensed under the MIT License.
• Other Dependencies — Various open-source libraries under MIT, Apache 2.0, or similar permissive licenses.

8. Termination

This Agreement is effective until terminated. Your rights terminate automatically if you fail to comply with any terms. Upon termination, you must cease all use and destroy all copies of the Software.

9. Indemnification

You agree to indemnify and hold harmless the Licensor from any claims, damages, or expenses arising from your use of the Software, violation of this Agreement, or violation of any third-party rights.

10. Age Requirement

You must be at least 16 years of age to use this Software. Users between 16 and 18 must have parental or guardian consent.

11. Amendments

The Licensor reserves the right to modify this Agreement at any time. Updated terms will be included with new versions. Continued use constitutes acceptance of revised terms.

12. Governing Law

This Agreement shall be governed by the laws of the Czech Republic. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

13. Severability

If any provision is held invalid, it shall be modified to the minimum extent necessary or severed. Remaining provisions continue in full force.

14. Entire Agreement

This Agreement constitutes the entire agreement between you and the Licensor regarding the Software and supersedes all prior agreements.

15. Privacy and Data Collection

The Software does not collect personal data, telemetry, or analytics. See our Privacy Policy for details. The only network request is license validation for Pro users via Lemon Squeezy.
